Prime Golf Escapes – Terms and Conditions

Please read these Terms and Conditions carefully as they contain important information about your legal rights, remedies, and obligations.

By accessing or using the Prime Golf Escapes platform, whether via our website, mobile device, tablet, or other applications, you agree to comply with and be bound by these Terms and Conditions. 
These Terms constitute a legally binding agreement between you and Prime Golf Escapes B.V. 


1. Background

1.1 Company Information 
Prime Golf Escapes B.V. (“Prime Golf Escapes”, “we”, “us”, or “our”) is a company registered in the Netherlands with its registered office in the Netherlands. We operate the website and digital platform Prime Golf Escapes (the “Platform”).

1.2 Platform Purpose 
The Platform connects: 
● Property Managers or accommodation providers (“Hosts”) offering properties , and 
● Travelers (“Guests”) seeking to book such accommodations. 
Through the Platform, Hosts may list properties and Guests may discover and book those properties directly with the Host. 

1.3 Platform Role 
Prime Golf Escapes acts solely as a technology and booking platform facilitating the connection between Guests and Hosts. 
We: 
● do not own, operate, or manage properties, 
● are not a party to the accommodation agreement between Guest and Host, and 
● do not act as a tour operator or travel organizer. 
All accommodation services are provided by the Host. 

Prime Golf Escapes does not inspect, verify, supervise, guarantee, or endorse any property, Host, or listing published on the Platform.
Although we may review listings for quality purposes, we do not guarantee the accuracy, completeness, safety, legality, or suitability of any accommodation or the services provided by a Host.

1.4 Acceptance of Terms 
These Terms apply to anyone accessing or using the Platform, including registered users and visitors. 
By creating an account or making a booking, you agree to be bound by these Terms. 

1.5 Changes to Terms 
We may update these Terms at any time. Updated versions will be published on our website. 
Continued use of the Platform after such updates constitutes acceptance of the revised Terms. 


2. Accounts and Membership

2.1 Account Creation 
To list properties or make bookings, you must create an account on the Platform. 
You agree to provide accurate and complete information during registration. 

2.2 Eligibility 
You must be at least 18 years old to create an account or make bookings.

2.3 Account Security 
You are responsible for maintaining the confidentiality of your login credentials. 
You are responsible for all activities conducted under your account. 

2.4 Accuracy of Information 
You warrant that all information provided is accurate and kept up to date. 

2.5 Acceptable Use 
Users must not: 
● discriminate against others, 
● engage in abusive, offensive, or defamatory conduct, 
● misuse the Platform or its services. 
We reserve the right to suspend or terminate accounts that violate these Terms.


3. Hosts and Property Managers

3.1 Listing Properties 
Hosts may list accommodations on the Platform  
Hosts are responsible for: 
● the accuracy of property descriptions, 
● maintaining up-to-date availability calendars, 
● ensuring the property complies with applicable laws and regulations. 

3.2 Authority to List 
Hosts represent and warrant that they have the legal authority to: 
● list the property, 
● enter into accommodation agreements with Guests. 

3.3 Compliance with Laws 
Hosts must comply with all applicable laws including: 
● licensing requirements, 
● tax obligations, 
● safety regulations, 
● consumer protection laws. 

Hosts are solely responsible for the condition, maintenance, cleanliness, safety, accessibility, licensing, insurance, and legal compliance of their properties.

3.4 Managers or Agents 
Hosts may appoint property managers or agents to manage listings. 
Hosts remain responsible for actions taken by their appointed managers.


4. Booking Process

4.1 Searching and Booking
Guests may browse listings, check availability, and submit booking requests via the Platform.

4.2 Pre-Booking and Payment Authorization
Guests are required to make a pre-payment (e.g., €100) to submit a booking request (the “Pre-Booking”).

By making such pre-payment, the Guest:
● secures a temporary hold of up to 24 hours on the selected accommodation and dates, and
● authorizes Prime Golf Escapes to charge the full reservation amount to the provided payment method upon acceptance of the booking request by the Host.

4.3 No Confirmation at Pre-Booking Stage
A Pre-Booking does not constitute a confirmed reservation.
A binding booking is only established once full payment has been successfully received.

4.4 Review by Host
Following a Pre-Booking request, the Host (or property manager) may accept or decline the request within 24 hours.

4.5 Payment Upon Acceptance
If the booking request is accepted, the remaining balance (total price minus the pre-payment) will be charged automatically to the Guest’s payment method.

In addition, the Guest may be required to pay a security deposit in an amount determined by the Host, which will be communicated prior to booking confirmation and may be collected or authorized separately in accordance with the Host’s terms.

4.6 Failed Payment
If the full payment cannot be successfully processed:
● the Guest will be notified via email, and
● the Guest will have 24 hours to complete the payment by providing sufficient funds or an alternative payment method.

Failure to complete payment within this period may result in cancellation of the booking request.

4.7 Booking Confirmation
A booking is only confirmed once full payment (100% of the reservation amount) has been successfully received by Prime Golf Escapes.
Upon confirmation, a binding agreement is formed between the Guest and the Host.

4.8 Right to Decline
Prime Golf Escapes reserves the right, at its sole discretion, to refuse or decline any booking or Pre-Booking without obligation to provide reasons.

4.9 Accommodation Agreement
Upon confirmation, a binding agreement is formed between the Guest and the Host.
Prime Golf Escapes is not a party to the accommodation agreement and is not responsible for the performance of either the Guest or the Host under that agreement, including the provision of the accommodation, access to the property, or compliance with the agreed booking terms.

4.10 Guest Responsibilities
Guests agree to:
● respect the property and house rules set by the Host,
● comply with check-in and check-out times,
● ensure that the number of guests does not exceed permitted occupancy.

4.11 Personal Use
Bookings are personal and non-transferable unless approved by the Host.


5. Payments and Fees

5.1 Accommodation Charges
The total booking price includes:
● the accommodation price and fees set by the Host,
● all applicable taxes,
● applicable VAT.

5.2 Service Fees
Prime Golf Escapes may charge service fees to Hosts for use of the Platform.

5.3 Payment Processing
Payments may be processed through third-party payment providers.
Prime Golf Escapes acts as a collection agent on behalf of the Host.

5.4 Taxes
Guests are responsible for paying any applicable (e.g. tourist) taxes unless otherwise included.
Hosts are responsible for reporting and paying applicable taxes.

5.5 Refund of Pre-Payment
If:
● a Pre-Booking is declined by the Host, or
● full payment is not completed within the required timeframe,
the pre-payment amount will be refunded in full within 48 hours.

5.6 Prohibited Off-Platform Payments
Guests and Hosts agree not to arrange payments outside the Platform.


6. Cancellations and Refunds

6.1 Host Cancellation Policies 
Each listing specifies a cancellation policy determined by the Host. 
This policy governs in the event of cancellation. 

6.2 Guest Cancellation 
Guests may cancel bookings subject to the applicable cancellation policy. 

6.3 Host Cancellation 
Hosts should avoid cancelling confirmed bookings except in exceptional circumstances. 
If a Host cancels a booking, the Guest may be entitled to: 
● a refund, or 
● assistance in finding alternative accommodation. 

6.4 Refund Processing 
Refunds will be processed according to the applicable cancellation policy and payment provider procedures.

6.5 Cancellation Responsibility
Prime Golf Escapes is not responsible for cancellation decisions made by the Host or Guest and shall not be liable for any resulting losses.


7. Complaints and Disputes

7.1 Issues with Accommodation 
Guests should notify the Host promptly if issues arise during their stay. 
Hosts should use reasonable efforts to resolve problems.

7.2 Platform Assistance 
Prime Golf Escapes may assist in mediating disputes between Guests and Hosts but is not obligated to resolve disputes.

7.3 Direct Responsibility 
All disputes relating to the accommodation itself are primarily between the Guest and the Host. Prime Golf Escapes is not responsible for resolving disputes relating to the condition of the property, cleanliness, amenities, maintenance, guest behaviour, property access, or any services provided by the Host. While Prime Golf Escapes may, at its discretion, assist the Parties in reaching an amicable resolution, it has no obligation to investigate, adjudicate, or resolve such disputes.


8. User Conduct

Users agree not to: 
● damage properties, 
● violate local laws, 
● misuse the Platform, 
● circumvent the Platform to avoid fees. 
Guests are responsible for the conduct of all individuals staying at the booked property. 


9. Intellectual Property

9.1 All content on the Platform, including but not limited to:

text,
● images,
● logos,
● branding,
● design,
● software,
● other materials,

is owned by or licensed to Prime Golf Escapes.

Users may not copy, reproduce, distribute, modify, or use any Platform content without prior written permission from Prime Golf Escapes.

9.2 By submitting content to the Platform, including but not limited to reviews, photographs, descriptions, and other materials, users grant Prime Golf Escapes a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, distribute, and promote such content for the purpose of operating, marketing, and improving the Platform and Prime Golf Escapes services.

9.3 Reviews published on the Platform reflect the opinions of individual users and do not represent the views, statements, or endorsement of Prime Golf Escapes.


10. Platform Availability

We aim to keep the platform available at all times but cannot guarantee uninterrupted access. Prime Golf Escapes does not guarantee that the Platform will be free from interruptions, errors, delays, viruses, or other technical issues and shall not be liable for any losses arising from temporary unavailability of the Platform.
We may modify, suspend, or discontinue parts of the Platform at any time. 


11. Liability

11.1 To the maximum extent permitted by applicable law, Prime Golf Escapes is not responsible for:

● the condition, safety, cleanliness, maintenance, legality, or suitability of any accommodation,

● the accuracy, completeness, or reliability of property descriptions, photographs, amenities, availability, pricing, or other information provided by a Host,

● the acts, omissions, negligence, misconduct, or breach of obligations by any Host, Guest, or third party,

● cancellations, delays, overbookings, or failures by a Host to provide the booked accommodation or related services,

● loss, theft, damage to property, personal injury, or any indirect or consequential losses arising from a Guest’s stay or use of an accommodation.

11.2 Guests acknowledge that accommodation services are provided solely by the Host. Any claims, complaints, or disputes relating to the accommodation itself, including its condition, safety, amenities, availability, or the Host’s performance, should primarily be addressed with the Host.

11.3 Prime Golf Escapes is not responsible for services provided by third parties, including payment service providers, internet service providers, mapping services, or other external platforms or providers used in connection with the Platform.

11.4 Nothing in these Terms limits or excludes liability for:

● death or personal injury caused by negligence,

● fraud or fraudulent misrepresentation,

● any liability that cannot legally be excluded or limited under applicable law.


12. Force Majeure

Neither Prime Golf Escapes, nor Hosts shall be liable for failure to perform obligations due to events beyond reasonable control, including: 
● natural disasters, 
● government restrictions, 
● travel bans, 
● pandemics. 


13. Privacy

We process personal data in accordance with our Privacy Policy.
By using the Platform, you consent to such processing. 


14. Termination

We may suspend or terminate accounts.
Users may close accounts at any time.


15. Governing Law

These Terms are governed by the laws of the Netherlands.
Disputes are subject to Dutch courts unless consumer law states otherwise.
